Terms of Service

1. Acceptance of Terms

By downloading, installing, or using any Lumena Productions application ("Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Apps.

2. License Grant

Subject to these Terms, Lumena Productions grants you a limited, non-exclusive, non-transferable, revocable license to use our Apps for your personal or organizational use. This license does not allow you to:

  • Modify, reverse engineer, decompile, or disassemble the Apps
  • Redistribute, sublicense, or resell the Apps
  • Use the Apps for any unlawful purpose
  • Remove any proprietary notices or labels from the Apps

3. Subscriptions and Payments

Some of our Apps require a paid subscription to access full functionality.

  • Trial Period: We may offer a trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.
  • Billing: Payment will be charged to your Apple ID account at confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Price Changes: Subscription prices may change. We will notify you in advance of any price changes. Continued use after a price change constitutes acceptance of the new price.
  • Cancellation: You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. Cancellation takes effect at the end of the current billing period.
  • Trial Forfeiture: Any unused portion of a trial period will be forfeited when you purchase a subscription.

4. Refunds

All purchases and subscriptions are processed through the Apple App Store. Refund requests must be directed to Apple in accordance with their refund policies. Lumena Productions does not process refunds directly. You may request a refund from Apple at reportaproblem.apple.com.

5. Acceptable Use

You agree to use our Apps only for lawful purposes. You shall not:

  • Use the Apps to broadcast, record, or distribute content that is illegal, harmful, threatening, abusive, or otherwise objectionable
  • Attempt to gain unauthorized access to any part of the Apps or related systems
  • Use the Apps in any way that could damage, disable, or impair their functionality
  • Use the Apps to infringe upon the intellectual property rights of others

6. Intellectual Property

All content, features, and functionality of the Apps, including but not limited to software, text, graphics, logos, and icons, are the exclusive property of Lumena Productions and are protected by copyright, trademark, and other intellectual property laws.

7. Your Content

You retain all rights to content you create, produce, or broadcast using our Apps. Lumena Productions claims no ownership over your content. You are solely responsible for ensuring your content complies with applicable laws and does not infringe on the rights of others.

8. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LUMENA PRODUCTIONS DOES NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMENA PRODUCTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APPS.

10. Indemnification

You agree to indemnify and hold harmless Lumena Productions from any claims, damages, losses, or expenses arising out of your use of the Apps or violation of these Terms.

11. Termination

We may terminate or suspend your access to the Apps at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the Apps after changes are posted constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
